1. What this is

These terms cover the photos and information you submit when applying to become a creator with Toys4Fans GmbH, Theaterstraße 3, 30159 Hannover, Germany (Managing Director: Jakob-Moritz Bach). At this stage you are an applicant. No creator relationship exists yet, and none arises from applying. A full creator agreement, with its own terms and compensation, is signed only if we accept your application and you agree.

2. What we ask for — and what we do not

We ask only for non-explicit face and body photos, together with the details in the form (name, contact, date of birth, reach, links). We use them solely to assess your application — to check eligibility, authenticity and technical feasibility. Do not upload explicit, sexual or nude images at this stage. The form is not intended for such material; any explicit image we receive is deleted without further processing. We do not publish, advertise, print, post, sell, sublicense or otherwise make your images public, and we do not use them commercially. Any such use would require a separate signed creator agreement.

3. Limited licence for review only

You grant us a non-exclusive, revocable, royalty-free licence to store and view your photos internally for the sole purpose of assessing your application. You may withdraw this licence at any time. We may share your photos with a vetted service provider only where needed for the assessment, and only under a data-processing agreement that binds them to the same limits.

4. Your confirmations

You confirm that: you are 18 or older and legally competent; every person shown is you alone and 18 or older; you hold all rights in the photos; the photos are lawful, non-explicit and contain nothing prohibited; and you upload them voluntarily and unaltered. If you culpably breach these confirmations, you indemnify us against resulting justified third-party claims, including reasonable legal costs.

5. Sensitive data and your consent

Although we ask only for non-explicit photos, in the context of an application to create adult products even clothed face and body images can reveal information concerning your sex life within the meaning of Art. 9 GDPR. For that reason we process these photos only on your explicit consent. By ticking the separate box, you consent to us collecting, storing and viewing this data for the assessment purpose in Section 2 (Art. 9(2)(a) GDPR). This consent is separate from the licence in Section 3, is entirely voluntary, and you can withdraw it at any time, as easily as you gave it. Any explicit material — which you must not upload — is not covered by this consent and is deleted unread.

6. Deletion and retention

If we reject your application, or you withdraw it, or you withdraw your consent, we stop processing and delete your photos — without undue delay on withdrawal, and at the latest within 30 days of our decision. We keep them only where the law still allows it (for example to defend a legal claim), and we will tell you if so. Withdrawal does not make unlawful any processing carried out before it. You can ask about your photos, or request their deletion, at any time at creator@toys4fans.com.

7. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, and under mandatory law (including data-protection law). For ordinary negligence we are liable only where we breach an essential contractual duty, and then only for the typical, foreseeable loss. All other liability for ordinary negligence is excluded.

8. Governing terms and updates

German law applies; mandatory consumer-protection provisions of your country of residence remain unaffected. If any provision is invalid, the rest stays effective. We may update these terms for future submissions; the version in force when you submit governs that submission and does not change afterwards.
