1. Scope & who we sell to

These terms apply to all orders placed in the TOYS4FANS online store, operated by Toys4Fans GmbH, Luhnenstraße 7, 30559 Hannover, Germany (see Imprint). Our products are intended for adults only — by ordering, you confirm that you are 18 or older.

2. How the contract is formed

The presentation of products in our store is not a binding offer but an invitation to place an order. By clicking the order button you submit a binding offer to buy. We accept your offer by dispatching the goods or by sending a separate order confirmation; the automated e-mail acknowledging receipt of your order does not yet constitute acceptance. Before submitting your order you can review all your entries and correct input errors at any time using the usual keyboard and mouse functions and the correction step shown during checkout. The contract language is English. We store the contract text and send you the order details by e-mail.

3. Prices, currency & payment

All prices are total prices and include statutory German VAT; they are shown inclusive of VAT before you complete your order (§ 1 PAngV). Our reference prices are quoted in euro (EUR).

Depending on your delivery region, our store may display and charge prices in a different currency. In particular, customers in the Americas see and pay in US dollars (USD). Where a currency other than the euro is shown, the amount is converted from our euro reference price at the exchange rate in effect at the time you place your order; because that rate follows the current market rate, the converted amount can change from day to day. The total shown to you in your checkout currency, at the moment you place your order, is the binding amount you agree to pay.

We accept the payment methods shown at checkout, including instalment payment via Klarna. Where you choose Klarna, Klarna's own terms apply and, for instalments, Klarna carries out a credit assessment. Your statement will show a charge by Toys4Fans GmbH.

4. Delivery & shipping costs

Orders are dispatched in discreet, neutral packaging with a neutral sender. Unless a different period is agreed, we dispatch in-stock items without undue delay and deliver at the latest within 30 days of conclusion of the contract (Art. 246a § 1 EGBGB). If an item is temporarily unavailable, we will inform you without undue delay.

Shipping is free to more than 100 countries. For a number of selected island and remote destinations a flat shipping charge of €19.99 applies; for a small number of very remote destinations — Fiji, Mauritius, Guernsey, Jersey and Norfolk Island — a flat charge of €49 applies. The exact shipping cost for your destination is shown at checkout before you complete your order. Shipping charges are stated here in euro and, like product prices, are shown converted into your checkout currency where that is not the euro (see section 3). We deliver only to the countries selectable in the checkout; if we cannot ship to your country, the address form will tell you before you pay.

Delivery outside the European Union is made on a DAP basis (Delivered At Place): import duties, customs charges and local taxes may be levied by the destination country. These are not included in our prices and are payable by you to the carrier or the customs authority when the parcel arrives. Within the European Union, all applicable taxes are included and there is nothing further to pay on delivery.

5. Right of withdrawal

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods. To exercise your right of withdrawal you must inform us — Toys4Fans GmbH, Luhnenstraße 7, 30559 Hannover, Germany, e-mail info@toys4fans.com — of your decision to withdraw by a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for the supplementary costs arising from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We make the reimbursement using the same means of payment you used for the original transaction, unless expressly agreed otherwise; you will not be charged any fees for the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied proof of having sent them back, whichever is the earlier. You must send back the goods without undue delay and no later than 14 days from the day on which you notify us of your withdrawal. You bear the direct cost of returning the goods. You are liable for any diminished value of the goods only if that loss of value results from handling other than what is necessary to establish their nature, characteristics and functioning.

Exclusion (§ 312g para. 2 no. 3 BGB). The right of withdrawal does not apply to sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery. Our products are supplied hygiene-sealed; once the seal has been broken, the item can no longer be returned.

6. Warranty

Statutory warranty rights apply. If a product arrives damaged or defective, contact us at support@toys4fans.com and we will make it right.

7. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of your country of residence remain unaffected.
